Kim Nhung Marketplace Inc, a food importer based in Seattle, Washington, failed to establish and maintain a Foreign Supplier Verification Program (FSVP) for frozen taro, frozen steam sweet corn, frozen tapioca noodles, and rice imported from foreign suppliers, in violation of Section 805 of the Federal Food, Drug, and Cosmetic Act. The company did not develop adequate risk-based verification activities to ensure that the imported food products met applicable U.S. food safety standards, a requirement that was first identified during an inspection on March 20, 2019, and remained unresolved at a follow-up inspection conducted in May 2021. Despite receiving FDA Form 483a observations documenting these violations at both inspections and submitting a response in June 2021, the company's corrective actions were insufficient to achieve compliance with 21 CFR Part 1 Subpart L.
