Za Imports Inc, a domestic cigar importer, failed to remit required user fee assessments to the FDA as mandated by the Family Smoking Prevention and Tobacco Control Act. Because the company did not pay user fees for fiscal quarters in 2020 by their respective due dates, all regulated tobacco products imported by Za Imports Inc were deemed adulterated under the Federal Food, Drug, and Cosmetic Act. The Center for Tobacco Products determined that cigars and other tobacco products imported without payment of assessed user fees violated section 919 of the FD&C Act and section 902(4) standards for adulterated products.
