Northland Vapor Company was warned that its e-liquid products sold on northlandvapor.com constitute tobacco products subject to FDA jurisdiction under the Family Smoking Prevention and Tobacco Control Act, yet lacked required premarket authorization orders for these "new tobacco products." The company failed to comply with Federal Food, Drug, and Cosmetic Act requirements applicable to deemed tobacco products, which have been under FDA regulation since August 8, 2016. The Center for Tobacco Products determined the products were being manufactured and offered for sale or distribution in the United States without the legally required marketing authorization.
