Vapor Rage LLC was warned for manufacturing and distributing e-liquid tobacco products without obtaining required premarket authorization orders, in violation of the Family Smoking Prevention and Tobacco Control Act and the Federal Food, Drug, and Cosmetic Act. The FDA determined that the company's e-liquid products sold through their website constituted newly deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, but were being marketed without the legally mandated premarket review and authorization. The company failed to comply with section 910 of the FD&C Act, which requires new tobacco products to obtain marketing authorization before being commercially distributed in the United States.
