Flair Products LLC/Flair Vapor LLC was warned for manufacturing and distributing electronic nicotine delivery system (ENDS) products without obtaining required premarket authorization from the FDA. The company's ENDS products, including e-cigarettes and e-liquids sold through their website, were deemed tobacco products subject to FDA jurisdiction under the Family Smoking Prevention and Tobacco Control Act but lacked the legally mandated premarket authorization order necessary for new tobacco products to be marketed in the United States. The Center for Tobacco Products determined that these products were being illegally offered for sale in violation of the Federal Food, Drug, and Cosmetic Act.
