Victorious Vapors LLC was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with FDA regulations governing newly deemed tobacco products, which have been subject to FDA jurisdiction since August 8, 2016, and are required to obtain premarket approval before commercial distribution. As an e-liquid manufacturer, Victorious Vapors' products met the definition of tobacco products under section 201(rr) of the Federal Food, Drug, and Cosmetic Act but were being marketed without the legally mandated "new tobacco product" authorization required under section 910(a) of the FD&C Act.
