The company's website was offering e-liquid products for sale in the United States without complying with FDA's deeming regulations, which classify e-liquids as tobacco products subject to federal oversight since August 2016. As "new tobacco products" not commercially marketed before February 15, 2007, the e-liquids were required to obtain marketing authorization orders under section 910 of the FD&C Act before being legally distributed.
