Vapor Springs LLC was warned that its e-liquid products sold through vapor-springs.com were tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act but lacked required premarket authorization orders for new tobacco products. The company failed to comply with the FD&C Act requirements applicable to e-liquids, which have been deemed tobacco products subject to FDA jurisdiction since August 8, 2016. The FDA determined these products were manufactured and distributed for sale in the United States without the legally required marketing authorization orders.
