The company's products, listed on their website cloudchasor.com, met the FDA definition of tobacco products subject to regulation as electronic nicotine delivery systems (ENDS) but lacked the necessary marketing authorization required for "new tobacco products" under section 910 of the FD&C Act. The Center for Tobacco Products determined these e-liquids were being offered for sale or distribution in the United States without compliance with applicable FDA requirements for premarket review.
