Vape Hut Inc was warned that its e-liquid products sold on vapehut.com were subject to FDA regulation as tobacco products under the Family Smoking Prevention and Tobacco Control Act, but lacked required premarket authorization orders for new tobacco products. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which mandates that new tobacco products obtain marketing authorization before legal distribution in the United States. The Center for Tobacco Products determined these e-liquid products were being manufactured and offered for sale without the necessary FDA approval required since the August 8, 2016 deeming rule extended regulatory jurisdiction to e-cigarettes and e-liquids.
