The company's e-liquid products, deemed tobacco products effective August 8, 2016, were subject to FDA jurisdiction as electronic nicotine delivery systems but lacked the necessary "new tobacco product" premarket approval required for products not commercially marketed before February 15, 2007. The FDA determined through inspection records and submission review that iSmoke was offering these products for commercial sale and distribution in the United States without compliance with applicable tobacco product regulations.
