Chula Vista Imports Ltd., a food importer based in Chicago, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) for any of the foods it imported, including frozen strawberries from Mexico, frozen mango cubes, and chocolate-flavored coating, in violation of FDA regulations. During an April 2021 inspection, FDA investigators found that the company did not comply with section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1 subpart L requirements for risk-based verification activities to ensure imported foods met U.S. food safety standards. The company had previously received a Form FDA 483a documenting these FSVP observations on April 22, 2021, but failed to provide a response to the FDA.
