Weidenhamer and Morin Enterprises LLC, doing business as Liquivape, was warned that its e-liquid tobacco products sold through its website were not in compliance with the Family Smoking Prevention and Tobacco Control Act. The company failed to obtain required premarket authorization orders for these "new tobacco products" before marketing them in the United States, as mandated by section 910 of the Federal Food, Drug, and Cosmetic Act. The FDA determined that the e-liquids met the definition of regulated tobacco products subject to FDA jurisdiction under the deeming rule effective August 8, 2016, and were being offered for sale or distribution without proper authorization.
