The company's e-liquid products, identified through their website at locallegendsatx.com, were deemed tobacco products subject to FDA regulation but lacked the marketing authorization required for "new tobacco products" under section 910 of the FD&C Act. The Center for Tobacco Products determined the products were being offered for sale and distribution in the United States without complying with applicable FDA requirements for newly deemed tobacco products that took effect August 8, 2016.
