ATL Vaping Inc. was cited for manufacturing and selling e-liquid tobacco products without obtaining required premarket authorization orders, in violation of the Family Smoking Prevention and Tobacco Control Act and the Federal Food, Drug, and Cosmetic Act. The FDA determined that e-liquids sold through the company's website (shopatlvaping.com) qualified as newly deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, and therefore required premarket approval before legal marketing in the United States. The company failed to comply with section 910 of the FD&C Act, which mandates that new tobacco products obtain marketing authorization orders prior to sale.
