Blackout Vapors Inc. was cited for marketing electronic nicotine delivery systems (ENDS/vaping products) that were misbranded under the Family Smoking Prevention and Tobacco Control Act. FDA's review of the company's website found that advertising for multiple ENDS products, including Hush Max Disposable – Strawberry Kiwi and Lucid Air Disposable Vape – Aloe Grape Ice, failed to include the required nicotine warning statement ("WARNING: This product contains nicotine. Nicotine is an addictive chemical.") as mandated by 21 CFR 1143.3(b). The company's failure to display this warning in all ENDS product advertising violated federal law governing tobacco product marketing.
