Ferrum City Liquid manufactured and sold e-liquid tobacco products containing nicotine without obtaining required premarket authorization orders as mandated by the Federal Food, Drug, and Cosmetic Act. The FDA determined that the company's products, marketed through their website, were subject to FDA jurisdiction as tobacco products under the expanded definition that includes nicotine from any source, effective April 14, 2022. The products were found to be in violation of premarket authorization requirements that apply to all new tobacco products not commercially marketed in the United States before February 15, 2007.
