Five Pawns, LLC was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization from the FDA. The company's e-liquid products, which contain nicotine and fall under FDA jurisdiction as tobacco products, were not in compliance with the Federal Food, Drug, and Cosmetic Act requirements for new tobacco products. The FDA noted that under legislation signed in March 2022, the definition of tobacco products was expanded to include all products containing nicotine from any source, further bringing Five Pawns' products under regulatory oversight and the requirement to obtain premarket authorization before legal marketing in the United States.
