JJDS E Cigarettes LLC d/b/a TKO Vapor Roswell manufactured and distributed e-liquid tobacco products without obtaining required premarket authorization from the FDA, in violation of the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with FDA regulations applicable to newly deemed tobacco products (electronic nicotine delivery systems), which have been subject to FDA jurisdiction since August 8, 2016. The violations centered on the distribution of unapproved "new tobacco products" that were not commercially marketed in the United States prior to the February 15, 2007 grandfather date.
