Bulldog Vapor, LLC was warned that its e-liquid products sold on its website were tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act, but lacked required premarket authorization orders for new tobacco products. The company failed to comply with Federal Food, Drug, and Cosmetic Act requirements applicable to e-liquids and other newly deemed tobacco products, which have been under FDA jurisdiction since August 8, 2016. The FDA determined these e-liquids were being manufactured and offered for sale in the United States without the legally required marketing authorization before being introduced to commerce.
