Vapor Tech Hawaii, Inc. manufactured and distributed e-liquid tobacco products without obtaining required premarket authorization from the FDA, in violation of the Family Smoking Prevention and Tobacco Control Act. The company's e-liquid products, which are electronic nicotine delivery system products deemed subject to FDA regulation as of August 8, 2016, were being offered for sale or distribution in the United States without the necessary marketing authorization order required for new tobacco products under section 910 of the FD&C Act. The FDA determined that these products lacked the premarket approval mandated for any tobacco product not commercially marketed in the United States prior to February 15, 2007.
