Wadina Distribution Company LLC d/b/a Gost Vapor was warned for manufacturing and distributing e-liquid tobacco products containing nicotine without obtaining required premarket authorization orders from the FDA. The company's products, offered for sale through their website, were determined to fall under FDA jurisdiction as tobacco products under the Federal Food, Drug, and Cosmetic Act, including those containing nicotine from any source following the March 2022 legislative expansion of FDA's tobacco authority. The company failed to comply with FD&C Act requirements applicable to "new tobacco products" that were not commercially marketed in the United States as of February 15, 2007.
