ADP Marketing LLC d/b/a Vaporistic, an e-liquid manufacturer and distributor, was cited for failing to obtain premarket authorization required under the Family Smoking Prevention and Tobacco Control Act for their tobacco products. The company's e-liquid products, which contain nicotine (whether derived from tobacco or other sources following March 2022 legislative amendments), were determined to be subject to FDA jurisdiction but lacked the legally required premarket approval before commercial distribution in the United States. The FDA found the products to be unapproved and therefore adulterated and/or misbranded under the Federal Food, Drug, and Cosmetic Act.
