Vapor Invasion LLC was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization, in violation of the Federal Food, Drug, and Cosmetic Act. The FDA determined that products listed on the company's website contained nicotine and fell under FDA jurisdiction as tobacco products, including those made with nicotine from non-tobacco sources following the March 2022 legislative expansion of FDA tobacco product authority. The company failed to comply with the requirement that "new tobacco products" obtain premarket authorization orders before being legally marketed in the United States.
