The FDA's Center for Tobacco Products determined that the company's e-liquids, identified as newly deemed tobacco products subject to FDA jurisdiction since August 8, 2016, were being offered for sale through their website without compliance with Federal Food, Drug, and Cosmetic Act requirements. The violation centered on the company's failure to obtain a marketing authorization order under section 910 of the FD&C Act, which is required for any new or modified tobacco products not commercially marketed in the United States prior to February 15, 2007.
