MUUV Holdings Inc. was warned that its nicotine pouch products, manufactured and sold through its website, are tobacco products subject to FDA jurisdiction and must comply with the Federal Food, Drug, and Cosmetic Act. The company failed to obtain required premarket authorization orders before marketing these "new tobacco products" that were not commercially available in the United States as of February 15, 2007. This violation became more critical following March 2022 legislation that expanded FDA's tobacco jurisdiction to include products containing nicotine from any source, not solely tobacco-derived nicotine.
