Vaporistic Bayville, which manufactures and distributes e-liquid tobacco products under the brand STR8VAPE, was cited for failing to obtain required premarket authorization for new tobacco products as mandated by the Family Smoking Prevention and Tobacco Control Act and the Federal Food, Drug, and Cosmetic Act. The company's e-liquid products, deemed tobacco products effective August 8, 2016, were being commercially distributed without the necessary marketing authorization orders required under section 910 of the FD&C Act for products not marketed in the United States prior to February 15, 2007.
