E-Cig Barn, LLC manufactured and sold e-liquid tobacco products without obtaining required premarket authorization orders as mandated under the Family Smoking Prevention and Tobacco Control Act. The company's e-liquids, which qualify as newly deemed tobacco products subject to FDA jurisdiction since August 8, 2016, were being distributed through their website in violation of section 910 of the Federal Food, Drug, and Cosmetic Act, which requires marketing authorization for new tobacco products not commercially available prior to February 15, 2007. The FDA's Center for Tobacco Products identified these compliance failures during a review of the company's website operations.
