CLS Trading, LLC d/b/a Vape Dudes HQ was warned that e-liquid products sold through its website were subject to FDA tobacco product regulation under the Family Smoking Prevention and Tobacco Control Act, as e-liquids are deemed tobacco products effective August 8, 2016. The company failed to obtain required premarket authorization orders for these "new tobacco products" before marketing them in the United States, as mandated under section 910 of the Federal Food, Drug, and Cosmetic Act. The products were found to be adulterated and misbranded due to lacking the necessary regulatory compliance and approval prior to commercial distribution.
