The company's products, offered through their Shopify website, were deemed tobacco products subject to FDA jurisdiction under the Family Smoking Prevention and Tobacco Control Act but lacked the mandatory premarket authorization orders required for new tobacco products under section 910 of the Federal Food, Drug, and Cosmetic Act. The Center for Tobacco Products determined the products were being distributed in the United States in violation of FDA regulations governing newly deemed tobacco products, which became effective August 8, 2016.
