Cloud Chasers Apothecary LLC was warned that its e-liquid products, sold through its website, are tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act and require premarket authorization orders before legal marketing in the United States. The company failed to comply with FD&C Act requirements by manufacturing and distributing e-liquids without obtaining the required "new tobacco product" marketing authorization orders, as these products were not commercially marketed in the U.S. prior to the February 15, 2007 predicate date. The Center for Tobacco Products identified these violations during a website review conducted on January 29, 2021.
