Sugar Vapor Company was warned that its e-liquid tobacco products listed on its website lacked required premarket authorization orders as mandated for "new tobacco products" under the Family Smoking Prevention and Tobacco Control Act. The FDA determined that the company's e-liquids met the definition of tobacco products subject to FDA jurisdiction and were being manufactured and offered for sale without the legally required marketing authorization. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which requires premarket approval for any tobacco products not commercially marketed in the United States prior to February 15, 2007.
