Dripco LLC, operating as Dripco Vape Company, was warned that its e-liquid tobacco products sold through its website were not in compliance with the Federal Food, Drug, and Cosmetic Act. The company failed to obtain required premarket authorization orders for its e-liquid products, which are deemed tobacco products subject to FDA regulation as of August 8, 2016. Under the Family Smoking Prevention and Tobacco Control Act, e-liquids marketed after February 15, 2007, are classified as "new tobacco products" and must receive FDA approval before legal commercial distribution in the United States.
