Vapes Gone Wild Juice, LLC was warned that its e-liquid products were subject to FDA regulation as tobacco products under the Family Smoking Prevention and Tobacco Control Act but were being manufactured and sold without required premarket authorization. The company's e-liquids, offered for sale on its website, met the FDA's definition of tobacco products as items made from or derived from tobacco and intended for human consumption, yet lacked the legally required "new tobacco product" marketing authorization orders mandated since the August 8, 2016 deeming rule. The FDA's inspection of the company's website determined these products were in violation of the Federal Food, Drug, and Cosmetic Act's requirements for legally marketed tobacco products in the United States.
