Premium Vapor Technologies LLC was warned that its e-liquid products sold through vapevta.com were tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act, but lacked required premarket authorization orders for new tobacco products. The company failed to comply with Federal Food, Drug, and Cosmetic Act requirements, including the mandate that "new tobacco products" obtain marketing authorization before being legally sold in the United States. The FDA's Center for Tobacco Products determined the e-liquids were manufactured and distributed without the necessary premarket approval required for products not commercially marketed in the U.S. as of February 15, 2007.
