Jojo's Smokeless World Inc. d/b/a Mod Shield was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization. The FDA determined that e-liquids sold through the company's website constitute "new tobacco products" under the Family Smoking Prevention and Tobacco Control Act and must comply with FDA regulations, including obtaining a premarket authorization order before legal marketing in the United States. The company failed to obtain the necessary premarket approval required for tobacco products not commercially marketed before February 15, 2007.
