The company's products, which were offered for sale on their website (podjuice55.com), were deemed tobacco products subject to FDA jurisdiction under the expanded definition that includes all products containing nicotine from any source, effective as of March 15, 2022. The FDA determined these e-liquids were adulterated and misbranded as they lacked the legally required premarket authorization needed for "new tobacco products" to be marketed in the United States.
