Freaz LLC d/b/a Vapor Wize, a Memphis-based manufacturer of e-liquid tobacco products, was warned for manufacturing and distributing e-liquids without required premarket authorization. Under the Family Smoking Prevention and Tobacco Control Act, e-liquid products are deemed tobacco products subject to FDA jurisdiction and must obtain marketing authorization before commercial distribution, particularly for products not commercially marketed prior to February 15, 2007. The company had failed to secure the necessary premarket approval required by section 910 of the Federal Food, Drug, and Cosmetic Act for its e-liquid offerings in the U.S. market.
