Massive Vapor, a manufacturer of e-liquid tobacco products, was found to be manufacturing and distributing tobacco products without required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. The company failed to comply with FDA requirements that "new tobacco products" obtain premarket authorization before being legally marketed in the United States, a requirement that extends to products containing nicotine from any source following March 2022 legislative amendments. The FDA inspection and review of company submissions revealed these e-liquid products were being offered for sale and distribution without the necessary FDA approval.
