Staccato Ventures LLC d/b/a Carolina Vape Kings, an e-liquid manufacturer, was warned that its nicotine-containing vape products are regulated as tobacco products under FDA jurisdiction and must comply with the Federal Food, Drug, and Cosmetic Act. The company failed to obtain required premarket authorization for its e-liquid products before marketing them commercially in the United States. The FDA's enforcement action reflected the March 2022 legislative expansion of tobacco product jurisdiction to include products containing nicotine from any source, not just tobacco-derived nicotine.
