Vapeoholic LLC was warned for manufacturing and selling e-liquid tobacco products without required premarket authorization under the Federal Food, Drug, and Cosmetic Act. The FDA determined that products listed on the company's website were tobacco products subject to FDA jurisdiction because they contained nicotine from any source, bringing them under expanded regulatory requirements effective April 14, 2022. The company failed to comply with FD&C Act requirements mandating premarket authorization orders for new tobacco products not commercially marketed in the United States as of February 15, 2007.
