Mena Produce LLC, an importer of fresh produce including Anaheim peppers, tomatillos, and poblano peppers, failed to establish and implement a Foreign Supplier Verification Program (FSVP) as required under 21 CFR part 1 subpart L. During inspections conducted in October 2020 and June 2022, the FDA found that the company had not developed adequate risk-based verification activities to ensure imported foods met applicable U.S. food safety standards, in violation of section 805 of the Federal Food, Drug, and Cosmetic Act. The company's response indicated it had prioritized facility certification over FSVP compliance and estimated it would require 3-4 months to develop FSVP programs for the inspected products.
