C. Liberatore LLC, a food importer based in Connecticut, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) for imported fresh produce including peppers and tomato on the vine, in violation of the Federal Food, Drug, and Cosmetic Act and 21 CFR Part 1, Subpart L. During FDA inspections conducted in April-May 2022 and April 2021, investigators found the company had not implemented any FSVP procedures for the foods it imported, despite being required to perform risk-based verification activities to ensure imported foods meet U.S. food safety standards. The company also failed to respond to the FDA Form 483a observations issued at the conclusion of the most recent inspection on May 5, 2022.
