Vital Vapers LLC was warned for manufacturing and distributing e-liquid tobacco products without required premarket authorization under the Family Smoking Prevention and Tobacco Control Act. The company's products, which contain nicotine and are intended for human consumption, were determined to be subject to FDA jurisdiction as tobacco products and required compliance with Federal Food, Drug, and Cosmetic Act regulations. The FDA noted that following March 2022 legislation expanding the definition of tobacco products to include those containing nicotine from any source, Vital Vapers' e-liquids must obtain premarket approval before legal distribution in the United States.
