Cloud Hempistry manufactured and distributed e-liquid products that the FDA determined to be tobacco products subject to federal regulation under the Family Smoking Prevention and Tobacco Control Act. The company failed to obtain required premarket authorization for these "new tobacco products" as mandated by section 910 of the Federal Food, Drug, and Cosmetic Act, and the products were found to be adulterated and misbranded in violation of FDA requirements. The Center for Tobacco Products issued this warning after reviewing the company's submissions and inspection records, establishing that Cloud Hempistry was selling e-liquid products without the necessary marketing authorization that has been required for newly deemed tobacco products since August 8, 2016.
