Bradley Jaramillo LLC d/b/a Trinity Vapor Lounge, a manufacturer and distributor of e-liquid tobacco products, was warned for operating without required premarket authorization for new tobacco products under the Family Smoking Prevention and Tobacco Control Act. The company failed to obtain FDA approval before manufacturing and commercially distributing e-liquid products, which are subject to FDA jurisdiction as deemed tobacco products since August 8, 2016. The violations involved distributing products that did not comply with premarket review requirements established under section 910(a) of the Federal Food, Drug, and Cosmetic Act for any tobacco products not commercially marketed prior to February 15, 2007.
