The FDA determined that the company's e-liquid products listed on their website (dtvapes.com) met the definition of newly deemed tobacco products subject to FDA jurisdiction as of August 8, 2016, but lacked the necessary marketing authorization to legally sell them in the United States. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which requires all new tobacco products not commercially marketed before February 15, 2007, to obtain premarket approval before distribution.
