Alymar LLC, a food importer based in Houston, Texas, failed to establish and maintain a Foreign Supplier Verification Program (FSVP) for imported beverages and snacks including cola soft drinks, potato chips, and corn chips, violating section 805 of the Federal Food, Drug, and Cosmetic Act and 21 CFR part 1, subpart L. The company did not develop any FSVP documentation for its imported foods despite multiple FDA inspections conducted in January 2020 and January 2022, and failed to respond to the Form FDA 483a observations issued on January 11, 2022.
