Vape Junkie EJuice was warned that its e-liquid products sold through its website constituted newly deemed tobacco products subject to FDA regulation under the Family Smoking Prevention and Tobacco Control Act but lacked required premarket authorization orders for legal marketing in the United States. The company failed to comply with section 910 of the Federal Food, Drug, and Cosmetic Act, which requires all new tobacco products not commercially marketed before February 15, 2007 to obtain FDA marketing authorization before sale or distribution.
