Madras Groceries, a food importer in Sunnyvale, California, failed to develop, maintain, and follow a Foreign Supplier Verification Program (FSVP) for imported snack foods including Butter Murukku and Banana Chips, in violation of section 805 of the Federal Food, Drug and Cosmetic Act and 21 CFR part 1, subpart L. During inspections conducted in December 2021 and January 2022, the FDA found that the company had not implemented any FSVP procedures for the foods it imported, despite the requirement that importers perform risk-based activities to verify that imported foods meet applicable U.S. food safety standards. The company had previously been inspected in March 2019 and failed to provide a response to the FDA's Form 483a observations issued on January 5, 2022.
